Terms of Service
Effective and last updated October 3, 2026
These Terms govern your use of Spotter Otter, including its free and paid subscription plans. By using the service, you agree to these Terms.
Spotter Otter looks for newly posted eBay listings on a best-efforts basis. Paid plans renew monthly or annually, according to your selection, until canceled. You can cancel online from Account → Subscription, and access continues through the end of the paid billing period. See Billing & Refunds for the full payment policy.
Who operates Spotter Otter
Spotter Otter is an independently operated online service based in Washington State, United States. In these Terms, “Spotter Otter,” “we,” “us,” and “our” refer to the operator of the Spotter Otter service. Customer and legal support is available at support@spotterotter.io.
Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to purchase a subscription or use Spotter Otter on your own. A minor may use the free service only with a parent or legal guardian’s permission and supervision.
What the service does
Spotter Otter monitors newly posted eBay listings from the time a Spotter starts and may alert you when a listing appears to match the criteria you provide. It does not alert on pre-existing inventory and does not buy, reserve, authenticate, inspect, or sell items. Searches, matching, check schedules, and alerts are provided on a best-efforts basis. API quotas, marketplace changes, network failures, delayed listing data, filters, maintenance, and other technical limits may delay or prevent a result or alert.
You are responsible for reviewing the live eBay listing before acting. Spotter Otter does not guarantee that it will find every listing, send every alert, identify an item correctly, find the lowest price, or produce any particular result.
Plans and usage limits
Plan prices, Spotter limits, check frequency, and features are shown before checkout. The Casual Otter (Free Tier) permits up to two active Spotters, automatic checks every six hours, and one individual manual check per day. The Treasure Otter (Collector Starter, $14.99/month or $134.91/year) permits up to ten active Spotters with automatic checks every 30 minutes. Each Spotter has a monthly AI scanning allowance based on its subscription tier. Scanning can pause when that allowance is reached or the search projects above its allowance. Usage remains counted through edits and subscription changes and resets at the start of each UTC calendar month. Paid manual checks remain subject to a short fair-use cooldown, and “Check all” is a paid feature.
We may reasonably enforce plan and abuse-prevention limits across devices associated with the same account or guest identifier. If plan features change materially, we will provide notice appropriate to the change. A change to a paid plan’s price will not take effect before the notice and timing described below.
Paid subscriptions and automatic renewal
The Treasure Otter offers monthly billing or annual billing at 25% off the cost of twelve monthly payments, paid upfront. The price and billing frequency are displayed before checkout. At checkout, you must check the box agreeing to these Terms before subscribing. By completing checkout, you authorize the payment provider shown there to charge the payment method you provide for the initial payment and automatically at your selected monthly or annual billing interval until you cancel.
For subscriptions sold through Link using Stripe Managed Payments, Link is the merchant of record for the transaction. Stripe handles checkout, payment details, receipts, and transaction support; Spotter Otter provides the subscription service and product support. Spotter Otter receives subscription, invoice, payment-status, and limited billing identifiers but does not receive or store your full card number. Promotions apply only as shown at checkout. Applicable taxes may be added when required.
Cancellation
You may cancel a paid subscription online at any time through Account → Subscription → Manage subscription. Stripe’s customer portal will show the effective cancellation date. Unless the portal states otherwise, cancellation takes effect at the end of the current paid billing period, you retain paid access through that date, and the subscription will not renew after that date. Deleting a Spotter or merely stopping use of the service does not cancel a paid subscription.
Refunds, upgrades, and billing problems
Subscription charges are generally non-refundable, and we do not automatically provide prorated refunds or credits for a partially used billing period, except where required by law. If you believe you were charged incorrectly, charged more than once, or could not use a paid feature because of a sustained service problem, contact support@spotterotter.io within 30 days of the charge. We will investigate and may issue a full or partial refund when appropriate. This policy does not limit any non-waivable consumer rights.
Manage your billing and cancellation from Account → Subscription. See the Billing & Refunds Policy for details.
Prices and changes
Prices are stated in U.S. dollars unless checkout says otherwise. We may change future subscription prices by giving advance notice before the change applies to a renewal. If you do not agree to a new price, you may cancel before it takes effect. We may correct obvious pricing errors before accepting a transaction.
Accounts and email
An account is optional for free guest use but required to purchase and manage a subscription. You must provide accurate account information, keep your password confidential, and notify us if you believe your account has been compromised. Account-verification, security, billing, password-reset, and Spotter-alert messages are service communications. They are not permission to add you to a marketing list.
You may sign out, revoke sessions on other devices, reset or change your password, or permanently delete your account and its Spotters through the account screen. A password reset signs out existing sessions. Account deletion cannot be undone. If you have an active paid subscription, cancel it through Account → Subscription before deleting the account so you retain access to the Stripe billing portal.
Photo and AI searches
Review AI-interpreted requirements and answer any clarification questions before starting. AI matching uses information supplied by sellers and can make mistakes; it does not establish authenticity or facts a listing does not support. Unconfirmed candidates may appear in Needs review without triggering match alerts. Saved history is not a complete index of eBay.
Reference-photo results are best-effort visual suggestions, not a guarantee of identity, model, variant, authenticity, condition, compatibility, or availability. Upload only images you own or have permission to use. Do not upload private documents, payment information, unlawful material, or images primarily depicting a person. You retain ownership of content you submit and grant us only the limited permission needed to process it and provide the requested feature.
Marketplace information and purchases
Listing titles, prices, shipping costs, availability, condition, seller information, images, and other marketplace data come from third parties and may be incomplete, delayed, inaccurate, or changed without notice. A price displayed by Spotter Otter is not a guaranteed final price.
Any purchase is solely between you, the seller, and the applicable marketplace. You are responsible for evaluating the item, seller, authenticity, condition, delivery terms, taxes, fees, return policy, and transaction risk. Spotter Otter is not a party to and has no responsibility for a purchase or seller dispute.
Third-party services
Spotter Otter relies on third parties including Cloudflare, eBay, OpenAI, Resend, and Stripe. Their availability and their own terms and privacy practices may affect the service. Spotter Otter is independent and is not sponsored or endorsed by eBay. eBay names, listing data, seller images, and links belong to their respective owners.
Affiliate disclosure
Spotter Otter participates in the eBay Partner Network, an affiliate program. Links to eBay listings on this site include eBay Partner Network tracking. If you buy an item after following one of those links, eBay may pay Spotter Otter a commission. The price you pay is the same. Commissions do not affect which listings a Spotter finds, how matches are judged, or which alerts you receive.
Acceptable use
You may not misuse the service, interfere with its operation, attempt unauthorized access, evade rate or usage limits, use automated means to overload it, introduce harmful code, scrape or resell its data, reverse engineer protected portions except where law permits, violate another person’s rights, or use it unlawfully.
Reviews, testimonials, and feedback
You may share honest opinions about Spotter Otter. Nothing in these Terms restricts a lawful, honest review. We do not buy or create fake reviews or condition an incentive on a positive sentiment. If we publish a testimonial or incentivized review, we will require it to reflect a genuine experience and disclose any material connection.
Intellectual property
Spotter Otter’s software, design, name, branding, and original content are owned by the service operator or its licensors and are protected by applicable law. These Terms give you a limited, revocable, non-transferable right to use the service for personal, lawful purposes. Third-party listing content remains the property of its respective owner.
Changes, suspension, and termination
Spotter Otter is an evolving service. We may change, limit, suspend, or discontinue features and may suspend access to protect the service, comply with law, manage provider quotas, address nonpayment, or respond to misuse. We will provide reasonable notice when practical for material changes that adversely affect a paid service.
Disclaimers
To the fullest extent allowed by law, Spotter Otter is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, or accuracy.
Limitation of liability
To the fullest extent allowed by law, the Spotter Otter service operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost opportunities, lost data, missed listings, purchases, or marketplace disputes arising from the service. Where liability cannot be excluded, total liability for claims relating to the service will not exceed the greater of the amount you paid for Spotter Otter during the previous 12 months or US $25.
Indemnity
To the extent allowed by law, you agree to defend and indemnify the Spotter Otter service operator from third-party claims arising from your unlawful misuse of the service or violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Courts located in Washington will have jurisdiction, except where non-waivable consumer law requires otherwise.
Changes to these Terms
We may update these Terms as the service changes. We will post the revised version and update the date above. For material changes affecting a paid subscription, we will provide notice appropriate to the change before it takes effect. Continued use after the effective date means you accept the revised Terms, except where additional consent is required by law.
General terms
If a provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the Billing & Refunds Policy form the agreement concerning Spotter Otter and replace prior discussions about the service.
